Online Law School Graduate to Take MA Bar

Currently California is the only state that allows graduates of online law schools to take the state bar exam, but a recent decision by the Massachusetts Supreme Court suggests change may be coming.

Ross Mitchell, a graduate of Concord Law School through online Kaplan University and a licensed attorney in California, sued the Board of Bar Examiners in Massachusetts for the right to sit for the state bar exam; he was prohibited from doing so because he didn't attend an ABA-accredited law school.

The court decided in Mitchell's favor, 6-1, citing his "exemplary degree of success" in law school as well as his admittance to the California bar.

Although the court was clear in limiting its findings to the facts before it, the decision will surely send a message to other online law school graduates that the opportunity to take the bar exam in their home states just may be worth fighting for.

I am a licensed attorney in California who has good standing in the CA bar for the past 5 years. I have applied for a waiver to sit for the February 2009 NY Bar Examination, and I would invite any bloggers input. Thank you.
